I think you could use the battle march and mark of chaos units, Call of Warhammer mod used them somewhat, and modified some, and they haven't been sued :P As long as you don't make profit out of it, it shouldn't be that big of a deal.
Or you can ask the Call of Warhammer mod team and import the models over to RTW from their mod...
