This bill goes along with the new ToS and serves to define the available penalties for certain levels of ToS violation.

Simple majority, one week.



This plaza moves the following:

1. Preamble and definitions
a) This bill exists to define the powers of staff with regard to directly implementing penalties for member who violate the Terms of Service.
b) "Moderator" here means any member of the moderation or administration staff who has rights to warn and ban members.
c) "Violation points" shall be numbered points given to a member by a moderator, dependent on the offence and up to a maximum value stated in the forum's Terms of Service.
d) The member's "violation record" shall be a record of Violation points.

2. Operation of the points system
a) Points shall either be "active" or "served"; served points are simply a record of past violations, and have no further effect.
b) All members always have the right to contest any points given, or penalties given, as a result of this bill, via a decision of the Tribounoi.
c) Members may request that points for an offence be considered "served" after a period of, at minimum, six months after the formal warning is given. This may be done by any moderator or administrator.
d) When the Terms of Service are amended, or related bills are implemented, the effects shall never be retrospective.

3. Warnings and post edits/deletion
a) Warnings shall be in the form of a personal message to the member being warned, explaining that points have been added to their violation record and the reasons for doing so.
b) At any time when violation points are given to a member, a formal warning should also be delivered. Moderators should save a copy of the PM to allow for the evidence being presented in a tribunal hearing. All such formal warnings should ideally include a link to remind the user of the current Terms of Service.
c) Material posted that is directly in violation of the Terms of Service should be removed at the time a warning is issued. Moderators should edit rather than delete posts to do so where possible.
d) Moderators should ideally take a screenshot of pre-edit posts that contain violations, to allow for the evidence being presented in a tribunal hearing.

4. Cooldowns
a) A cooldown shall be a ban lasting twenty-four hours.
b) A member should have at least one active warning before a cooldown is delivered.

5. Minor Bans
a) A minor ban lasts from three to five days, at the discretion of the moderator giving the ban.
b) A user must have at least eight active violation points before a minor ban can be given.

6. Major Bans
a) A major ban shall be a ban lasting from ten to twenty-one days, at the discretion of the moderator giving the ban.
b) A major ban may only be placed upon a member whose violation record exceeds or equals eighteen active points.

Clause 2d looks like it's been left behind from something copied and edited. If it's deleted, does that mean we have to restart the vote?

Not for what is basically a typo fix, I think. Edited and it's correct now, anyhow.
